The Freedom of Information Act and Privacy Act Division\/Office is responsible for administering policies, programs, and procedures to ensure DOE compliance with the Freedom of Information Act (FOIA) and the Privacy Act (PA), 5 U.S.C. 552 and 5 U.S.C. 552a, respectively.<\/p>\n

The resources on these pages are provided to aid in finding answers to your questions about programs of the Department of Energy and to obtain information that is publicly available without submitting a FOIA request. If the information is not available here, submit a\u00a0Freedom of Information Act request\u00a0electronically<\/a>.<\/p>\n

To assist obtaining publicly available information, we suggest you first conduct a search on the specific topic or information you are seeking using the SEARCH function on the\u00a0DOE Home Page<\/a>. From the results of the search if you can determine which DOE Program Office or Field Operations Sites might have the needed information, you can proceed to that location\u2019s Public Reading Facilities using the\u00a0FOIA Requester Service Centers and FOIA Public Liaisons list<\/a>. This list provides FOIA Web Page addresses for each location from which Public Reading Facility and DOE FOIA Public Liaison contact information can be obtained.<\/p>\n

Freedom of Information Act <\/strong><\/p>\n

The Freedom of Information Act allows individuals to obtain documents in the possession and control of agencies within the Executive Branch of the Federal Government. FOIA requests require NETL to conduct a search of existing documents to determine whether any are responsive to the request. NETL is not required to create a document in order to respond to a FOIA request or to answer questions posed under FOIA requests.<\/p>\n

The Privacy Act<\/strong><\/p>\n

The Privacy Act of 1974 allows individuals to learn how records containing personal information are collected, maintained, used, and disseminated by the Federal Government. The Act provides certain safeguards for the protection of this information. The Act permits an individual to gain access to personal information maintained by an Agency, and to seek amendment of any incorrect or incomplete information.<\/p>\n

How to Make a Request<\/b><\/h2>\n<\/div>

FOIA requests must be:<\/strong><\/p>\n

    \n
  • In writing<\/li>\n
  • Identified as a “Freedom of Information Act Request”<\/li>\n
  • Contain a reasonable description of the document(s) sought<\/li>\n
  • Include an assurance to pay search and\/or duplication fees<\/li>\n
  • Failure to follow these instructions could result in rejection of the request. Requests should be as specific as possible. If known, please provide as much information about the documents sought as possible. If the request is considered too vague or too burdensome to process, you will be contacted directly by the Freedom of Information Officer, who will assist you in narrowing the scope of your request. For FOIA requests that meet the requirements for processing, NETL normally responds within 20 working days.<\/li>\n<\/ul>\n<\/div>

    FOIA requests must be:<\/strong><\/p>\n

      \n
    • In writing and signed by the individual requesting the information<\/li>\n
    • Identified as a “Privacy Act Request”<\/li>\n
    • Include the identification information required by the Department’s regulations, Title 10, Code of Federal Regulations, Section 1008.4<\/li>\n
    • Specify if possible the title and identifying number of the system of records as listed in DOE’s published notices of systems of records<\/li>\n
    • Provide any additional information that will aid NETL in responding to the request<\/li>\n
    • Indicate if appropriate, the time, place and form of access sought.<\/li>\n
    • Requests should be as specific as possible. For Privacy Act requests that meet the requirements for processing, NETL normally responds within 10 to 20 working days from the date of receipt.<\/li>\n<\/ul>\n<\/div>
