The Nuclear Waste Policy Act assigns responsibility for development of a national system of nuclear high-level waste disposal to the Department of Energy. However, until the disposal system begins to operate, the utilities are responsible for spent fuel storage. To accommodate the growing inventory of spent fuel prior to system operation, many utilities must increase their storage capacity or face the possibility of shutting down their nuclear electric plants.
